A recently obtained access-to-information request reveals that Memorial University paid Stewart McKelvey lawyer Koren Thomson $42,606.88 to date to represent it in the Supreme Court of Newfoundland and Labrador case, Neil Bose, The President and Vice-Chancellor Pro Tempore of Memorial University of Newfoundland v. Michael Harvey, in his capacity as The Information and Privacy Commissioner of Newfoundland and Labrador et al.

In late 2023, access-to-information requests were filed for bonuses paid to executives of Memorial University’s Separately Incorporated Entities Genesis and C-CORE. Memorial denied access to the requested information, arguing that the records were not in its custody or control and that Genesis and C-CORE are not public bodies.

A complaint was filed with The Office of the Information and Privacy Commissioner. The Commissioner published a report on February 8, 2024, stating that Memorial does not have custody or control of the information. Memorial disagreed with the ruling and sought declaratory relief from the Court. The trial is set to take place in January 2025.
